Hazardous Weather and Emergency Conditions Leave Policy

The Governor has the sole authority to excuse employees of State government from reporting to work during extreme weather or other emergency conditions. The Governor shall issue a Declaration of emergency stating that, because of extreme weather or other specified emergency conditions, employees should not report to work. Unless such a Declaration of Emergency has been issues, all State government employees are expected to report for work.

The Declaration may be applicable to all employees in the entire State, or only to those employees in one geographical region of the State or combination of geographical regions. Non-essential employees who live or work within the region(s) specified in the Declaration will not be expected to report to work.

During a Declaration of Emergency, all essential and direct care services will be maintained. All Vice Presidents, Deans, Director and Department Heads shall identify essential employees by position, classification, or internal title and post a list thereof. No change of the essential employee roster should be authorized after the Governor's Declaration of an Emergency.

Nothing contained in this section precludes the necessary immediate evaluation of a facility by an individual in a supervisory capacity in the interest of personal safety

The hazardous weather and emergency policy shall be applicable to all employees of Clemson University.

Definitions.

"Emergency Conditions" means circumstances that would expose State employees to harmful or unsafe conditions, as determined by the Governor's Office.

"Essential Employees" means those employees notified and included on the essential employee roster whose services are required, regardless of conditions.

Notification of Declaration of Emergency.

Normal Working Hours-Once a decision for a closing has been made, it will be transmitted by telephone from the Governor's Office to the SCDHRM Director.

The SCDHRM Director or his designees will transmit the message to Clemson University in accordance with the list of representatives to be contacted in the case of an emergency declaration.

The Governor's Office will issue a statement to the news media concerning the release of State employees due to emergency.

Off-Duty Hours-Between the hours of 5:00 p.m. and 8:00 a.m., all Declarations of Emergency will be transmitted by the Governor's Office to the news media. Employees will assume an individual responsibility to respond in an appropriate manner to closings as they may be announced.

Compensation During Declaration of Hazardous Weather and Emergency Leave.

Section 8-11-57 of the SC Code of Laws allows the Governor to provide State employees up to five days of leave with pay for absences from work due to a declared state of emergency for hazardous weather. The State Human Resources Regulations provides three options for employees to account for lost work time should the Governor not provide leave for the hazardous weather, and/or should an employee not report to work (or report late to work). Employees are 1) allowed to use annual or compensatory leave, 2) allowed to take leave without pay, or 3) allowed to make up time lost from work.
